Professor Ken Attafuah, Lead Counsel for Amina Mohammed says he is happy at the decision by the Human Rights Court

Professor Ken Attafuah, Lead Counsel for Amina Mohammed, the woman at the center of the controversial mass rape story, says he is happy at the decision by the Human Rights Court, High Court Division to grant his client bail. 

He however said it must be noted that Amina has not been cleared of the charges leveled against her, only given bail in line with the dictates of the Constitution.

Prof. Attafuah told Citi News that Amina is prepared to cooperate with police investigations. 

“I must emphasize that securing bail for Amina does not mean she is innocent of the charges raised against her. We as Counsel are not saying that what she has told the world is necessarily true. We are just saying that the right of every person in conflict with the law must be protected and that the
offences which Amina has been charged for are bailable offences and that the High Court erred in not granting her bail in the first place, and failing to adduce reasons for the decision. We are happy that the Human Rights Court has granted her bail with those conditions” he noted.

Justice Paul Peter Derry, who sat on the case on Friday November 5 at the Human Rights Court, granted Amina bail to a tune of GH 5,000 with one surety.

One of Amina’s Lawyers, Mr. Andy Appiah-Kubi, pleaded with the court to issue an order to the lower court six – the court that remanded Amina in police custody – to ensure the execution of the bail.

Director of Public Prosecution, Gertrude Aikins, had prayed the court not to grant the bail for Amina’s own safety, citing the controversial nature of the story but Lawyer Appiah-Kubi disagreed and stated that if people’s safety can only be guaranteed in prison, then all Ghanaians should be imprisoned so that government can protect them better.

However, Justice Derry turned down the prosecution’s request.

Amina was arrested on Saturday October 30, and charged on Tuesday November two for publishing false information to cause fear and panic and deceit of a public official.
